Ada sebuah berita baru: “Rhoma Irama menggugat rumah produksi PT SR Rp 1 miliar. Ada 30 lagunya yang diaransemen ulang dan diunggah di youtube tanpa izin.” Menurut tergugat, kontrak kerja dan pembayaran sudah diselesaikan dengan kuasa Bang Haji berinisial YM. Karena belum ada titik temu, kasus ini akan berproses lewat jalur hukum. (Jawa Pos, 21/02/2021).

Ilustrasi kasus Bang Haji tersebut bukanlah fokus tulisan ini. Ia hanya untuk menunjukkan bahwa hak cipta musik dan lagu—tepatnya dunia entertainmen—bisa diperjuangkan hingga meja hijau untuk mendapatkan keadilan. Bahkan, untuk arasemen 30 lagu, nilai gugatannya fantastis: 1 miliar rupiah. Maka, jadilah saya berefleksi dan dengan sedih mengakui bahwa belum pernah ada hak cipta buku diperjuangkan sedemikian itu. Jika aransemen lagu bisa diperkarakan, bagaimana dengan pembajakan karya buku? Bukan hanya menggubah dan plagiarisme, melainkan “lebih sadis” lagi: kebiasaan memfotokopi buku meraja-lela di mana-mana. Setiap ada kampus dan sekolah, di sana berjejer copy center. Ini pelanggaran hak cipta yang dibiarkan!
Hak cipta buku belumlah berdaya. Sudah tertulis sih di sampul dalam setiap buku, bahwa upaya memperbanyak isi buku akan mendapat sanksi pidana atau perdata. Namun, masyarakat kita pelit menghargai buku. Jangankan mengerti jerih payahnya menulis (sehingga empati terhadap upaya plagiarism dan pembajakan buku secara ilegal), sedangkan membaca pun belum dianggap penting. Kebiasaan memfotokopi buku ya akibat tidak dihargainya penulis. Mereka tidak merasa perbuatan fotokopi itu identik membajak penghasilan penulis. Btw, buku saya Rahasia Top Menulis (2014) pernah dibajak: awal Januari 2015 terpajang di 142 TB Gramedia, dua bulan kemudian sudah ditemukan buku bajakannya di pasar buku loak, harganya 50%. Nah, bagaimana mungkin urusan begini akan dibawa ke pengadilan?[]
